Причуды американского законодательства:

Жители Сан-Франциско подали на собственные, ими же избранные, власти в суд, жалуясь, что власти развели бомжей и наркоманов, так что по улице пройти невозможно, везде грабят, машины бьют, воруют, и даже те законы, которые есть, не соблюдаются. В общем, какой-то неправильный социализм. Невозможно пользоваться никакими общественными местами, оплаченными из их же налогов. 

На что суд им разьяснил, что если бы их власти арестовали - тогда бы у них был повод жаловаться. А то, что власти не арестовывают других - пусть и грабителей, воров и бандитов - это не повод для жалоб. No standing. Гуляйте пешком (только где-нибудь вне Сан-Франциско, если рассудок и жизнь дороги вам).

Но тут оказался неожиданный забавный поворот. Некоторые из жителей Сан-Франциско ведь могут быть инвалидами. С каждым может случиться. А в отличие от рядовых лохов, инвалидов закон предписывает защищать. И то, что власти Сан-Франциско не обеспечили инвалидам безопасные условия проживания - в отличие от обычных лохов, опять же - как раз дело вполне подсудное. Если обычному гражданину из-за дерьма и бомжей пройти по улице нельзя - это его проблемы. А вот если это гражданин, защищённый ADA - то это уже проблема городских властей. Так что суд постановил, что в этом свете иск может быть продолжен, и городским властям придётся держать ответ в суде. Конечно, это не гарантирует успех самого иска - но по крайней мере суд нашёл в нём резонные основания.

Brandon Straka организовал в 2018м кампанию WalkAway, призывающую избирателей оставить Демпартию.

Он был немедленно обьявлен русским агентом - базируюсь на данных известной организации Hamilton 68, которая впоследствии была разоблачена, как мошенничество - они притворялись, что следят за русскими ботами и операциями влияния, но на самом деле ни хрена подобного не делали (и в соцсетях об этом знали - т.к. у них был доступ к реальным данным - но молчали).

Разумеется, немедленно развернулась кампания травли в прессе, от клоуна Кольбера до клоунов в CNN и Salon. Государственно-финансируемые институты Institute for Strategic Dialogue и Global Disinformation Index, обьявили WalkAway "группой ненависти". Тут же, совершенно независимо, PayPal, Venmo, Patreon, Constant Contact, MailChimp, Facebook, Instagram и другие независимые компании приняли независимое решение прекратить предоставлять услуги WalkAway и её основателю.

Все обвинения, конечно, были абсолютным и полным враньём - Твиттер провёл в это время внутреннее расследование и выяснил, что все контакты этой группы органические, базируются в США и никак не связаны ни с какими ботами и операциями влияния, и ровно никаких свидетельств какой-то связи этой группы с Россией нет. Этим расследованием они ни с кем никогда не поделились - до тех пор, пока оно не вышло наружу в Twitter Files.

На этом не закончилось - когда Страку обвинили в участии в демонстрации 6 января, USA Today oпубликовало статью с паническим заголовком "Insurrection fundraiser: Capitol riot extremists, Trump supporters raise money for lawyer bills online". Сам факт того, что люди собирают деньги на свою защиту, уже считается преступлением - разумеется, только для правых, для левых существуют массивные фонды, вносящие залоги и оплачивающие адвокатов, и поддерживаемые всей верхушкой вплоть до Камалы лично. Разумеется, идея в том, что подобные платформы - не контролируемые партией и позволяющие всяким негодяям - например, Trump supporters - собирать деньги на свою защиту в суде - должны быть уничтожены.
У деплораблей, по мнению партийцев, никаких прав быть не может. По отношению к ним позволено всё.

У Арбата тут подробный разбор дела Суссмана. Все хорошо и подробно, но есть одна серьезная ошибка.
Арбат говорит, по сути, что Суссмана опрадвали правильно - поскольку в ФБР все и так знали, что он работает на Клинтонов, поэтому никто обмануть их не мог. То, что в ФБР всё знали, с этим спорить не стану - т.е. кто лично знал, кто нет, разбираться сложно, но и ненужно - вся нужная информация у ФРБ точно была. 

Ошибка тут в том, что дела об обмане госслужащих так не работают. Собственно, в подавляющем большинстве случаев они работают ровно наоборот - ФБР задает будущему подсудимому вопросы, ответы на которые им уже известны, и уже имеются доказательства этого, и ждут, пока клиент соврет - или скажет что-то, что можно интерпретировать как враньё. Это совершенно стандартная разводка, тем более эффективная, что доказать враньё обычно гораздо проще (одна запись и всё!), чем оригинальный состав преступления - а доказывать, что то, о чём врал, было преступлением - совершенно не нужно. Более того, не нужно доказывать даже намерение ввести в заблуждение - если знал или должен был знать о том, что это неправда - этого достаточно. 

Собственно, так и с Флинном было. Для предьявления обвинения нужны две вещи - а) чтобы заявление было ложным (ну и что говорящий об этом знал) и б) чтобы оно было material - т.е. существенно, для ФБР, например, в контексте расследования. Т.е. если вас ФБРовец спросит, сколько у вас в кармане денег, и вы скажете - 20 долларов, а потом окажется, что в заднем кармане ещё лишний квотер завалялся - то вас, скорее всего, за это не посадят - или, по крайней мере, ФБР надо будет доказать, что наличие квотера существенно для их расследования, и что вы знали о квотере, отвечая на этот вопрос. При этом рамки существенности очень широкие - но они есть. А вот чего доказывать совершенно не надо - так это что кого-то действительно ввели в заблуждение, и что ФБРовцы (или кто другой) не знали, что их обманывают. Для состава этого преступления этого просто не нужно. Т.е. это такой очень дешевый способ создавать преступления практически из (сотрясения) воздуха. 

А почему же присяжные Суссмана оправдали? Ведь необходимые компоненты вроде присутствуют вполне ясно?
А это типичный случай того, что называется jury nullification. T.e. присяжные в американской судебной системе имеют право забить абсолютно на все законы и просто отказаться признать обвиняемого виновным, несмотря ни на что. Обычно это поведение считается не очень приличным для присяжных (за исключением заведомо неправосудных законов или каких-то исключительных ситуаций), и даже за упоминание о такой возможности может сильно влететь от судьи, а кандидата в присяжные, упомянувшего этот термин, легко могут не допустить в состав, чтобы воду не мутил. Однако тут Совсем Другое Дело, и верные партийцы сами знают, что в таких случаях надо делать. И делают.

Причём если кто-то думает, что дескать деплораблям тоже так можно - то не обольщайтесь. Судьи-то в DC известно какие, и проценты голосования за Демократов совершенно российские - причём если в России эти результаты подделывают, то в DC, скорее всего, они самые что ни на есть подлинные.
